Nord Haven Sauna and Cold Plunge LLC Participant Liability Waiver and Assumption of Risk Agreement Please read carefully before signing or submitting. By completing this form, you acknowledge that you have read, understood, and agree to the following terms and conditions. 1. Acknowledgment of Risk I understand that participating in sauna and cold plunge activities involves exposure to extreme heat and cold which can pose health risks. These risks may include but are not limited to dehydration, dizziness, fainting, heat exhaustion, cold shock, cardiovascular stress, flu like symptoms, skin irritation or infection, and other possible injuries or medical complications. I acknowledge that I am voluntarily participating in these activities and assume all risks associated with their use including any illness, infection, fall, slip, or accident that may occur before, during, or after participation. 2. Health Conditions I certify that I am in good physical health and capable of safely using sauna and cold plunge equipment. I acknowledge that I have been advised: • Pregnant individuals or those who may be pregnant should not enter the sauna or cold plunge. • Individuals under the influence of alcohol, drugs, or intoxicating substances are not permitted to enter. • Anyone with heart conditions, respiratory issues, high or low blood pressure, or other medical concerns should consult a physician before participation. Failure to follow these guidelines is my responsibility. 3. Assumption of Responsibility and Damages I accept full responsibility for my actions, physical condition, and safety while participating in any Nord Haven Sauna and Cold Plunge activities. Any damage to facilities, equipment, furniture, or property caused by myself or my guests will be my financial responsibility. The company reserves the right to charge for repair, replacement, or cleaning costs. Competitive behavior or endurance challenges are strictly prohibited. I agree that I will limit my sauna time to no more than 20 minutes per round at approximately 170 degrees Fahrenheit and that remaining longer is entirely at my own risk. 4. Alcohol, Food, and Intoxication Policy For the safety of all guests: • No alcohol or food is allowed inside the sauna or cold plunge areas. • Alcohol and food are only permitted in the lounge area. • Participants must not consume alcohol within one hour before using the sauna or cold plunge. • Anyone who appears intoxicated or impaired will be asked to leave without refund. Failure to comply may result in removal from the premises and possible permanent ban. 5. Hygiene and Illness Policy Participants experiencing fever, flu like symptoms, contagious illness, open wounds, or visible skin conditions such as ringworm, staph, or athlete’s foot should not use the sauna or cold plunge. All guests are required to wear sandals or proper foot protection in all sauna and common areas. Nord Haven Sauna and Cold Plunge LLC assumes no responsibility for any infection a participant may contract before, during, or after visiting Nord Haven. 6. Slip, Fall, and Accident Disclaimer Nord Haven Sauna and Cold Plunge LLC is not responsible for injuries resulting from slips, trips, or falls anywhere on the property including wet surfaces, uneven ground, or weather related conditions. I accept full responsibility for my own safety while moving throughout the property. 7. Release and Indemnification I waive and release Nord Haven Sauna and Cold Plunge LLC, its owners, affiliates, partners, employees, and contractors from any and all claims arising from my participation. I agree to indemnify and hold the company harmless from any claims, expenses, or damages arising from my conduct or misuse of equipment. 8. Personal Belongings and Property Disclaimer Nord Haven Sauna and Cold Plunge LLC is not responsible for lost, stolen, or damaged personal belongings including electronics, jewelry, clothing, or other items. 9. Refund and Removal Policy All sales are final and non refundable. No refunds or credits will be issued for early departure, rule violations, or missed sessions. The company may remove any participant for unsafe, disruptive, or inappropriate behavior or for failure to follow staff instructions. Severe or repeated violations may result in a permanent ban. 10. Emergency and Medical Response Consent In the event of an emergency, I authorize Nord Haven Sauna and Cold Plunge LLC to contact emergency services and provide reasonable assistance. I am responsible for any medical costs incurred. 11. Independent Operation I acknowledge that Nord Haven Sauna and Cold Plunge LLC operates independently from Shipgarten. Shipgarten assumes no responsibility for injuries or damages related to my participation in Nord Haven activities. 12. Media Release I grant permission to Nord Haven Sauna and Cold Plunge LLC to use photos, videos, or other media of me taken during my visit for marketing, social media, and promotional purposes. 13. Marketing and Email Consent By providing my email address, I authorize Nord Haven Sauna and Cold Plunge LLC to send promotional messages, updates, and invitations. I may opt out at any time by selecting unsubscribe or contacting the business. 14. Arbitration and Venue Any dispute arising under this agreement will be governed by the laws of the Commonwealth of Virginia and resolved exclusively in the courts of Fairfax County, Virginia. Electronic Signature and Agreement By checking the box and submitting this form electronically, I acknowledge that I have read and understand this waiver and voluntarily agree to its terms.
